Starting October 1, 2026, most Virginia stores that sell tobacco or nicotine need a permit from Virginia ABC. Selling without one is a misdemeanor. Here is a quick checklist. The permit applies per retail location. A convenience store or smoke shop that sells cigarillos alongside cigarettes, dip or vapes needs one. A dedicated cigar shop or cigar lounge that sells only cigars and pipe tobacco is exempt.

- Apply through Virginia ABC. The one-time fee is $400, or $300 if you already hold an ABC license.
- Background checks. Every owner with a 10% or larger stake needs one ($15 for Virginia residents).
- Know your renewal date. Permits approved before October 1, 2026 expire September 30, 2027.
- Check the vapor directory. If you sell liquid nicotine or vapor products, every product must be on the Attorney General's directory. Fines start at $5,000 per unlisted product and reach $15,000 for repeat violations.
- Expect inspections. Virginia ABC will do compliance checks, including underage-buyer operations.
