Upon placing an order, you will receive an order confirmation. This confirmation does not indicate acceptance of the order but acknowledges that we have received your request. A binding agreement is formed once we confirm shipment or process the payment.

3.3 Right to Reject Orders

Big Distro Inc. reserves the right to refuse any order for any reason, including but not limited to product unavailability or suspicion of fraudulent activity.

4. Pricing and Payment

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. Prices exclude applicable taxes, shipping, and handling fees unless explicitly stated otherwise. Any taxes or additional charges will be calculated and added during checkout based on your location and applicable laws.

4.2 Payment Terms

4.3 Late Payments

If a Customer fails to make a payment by the due date, Big Distro reserves the right to suspend further deliveries until the outstanding amount is paid.

5.Shipping, Freight, and Delivery 

5.1 Shipping Methods

Big Distro Inc. offers shipping, freight, and delivery services. Deliveries are made with an extra charge within the state of North Carolina or as otherwise agreed upon. Products may be shipped or freighted based on the size, weight, and destination of the order.

5.2 Shipping Costs

Shipping, freight, and delivery costs will be calculated and added during the checkout process. These charges vary based on the location, shipping method, and weight of the items ordered. Customers are responsible for these costs unless otherwise specified.

5.3 Delivery Timeframes

Shipping and delivery times are estimates and may vary due to factors beyond our control, such as carrier delays or weather conditions. Big Distro Inc. will make reasonable efforts to ensure timely delivery.

5.4 Risk of Loss

Risk of loss and title for the Products pass to the Customer upon delivery to the carrier, freight service, or when delivery is made to the Customer’s designated location.

5.5 Freight Services

For larger orders, Big Distro Inc. may arrange freight services. These will be handled through third-party freight carriers, and shipping terms will be coordinated directly with the Customer. Special freight handling requests may incur additional charges.

5.6 Delivery Delays

We are not liable for delays in shipping, freight, or delivery due to events beyond our control, including but not limited to strikes, natural disasters, carrier issues, or other unforeseen circumstances.

6. Returns and Cancellations 

6.1 Final Sale Policy

All sales are final. No returns or exchanges will be accepted, and there are no exceptions to this policy.

6.2 Reporting Issues

Breakage, damaged, or missing items must be reported to Big Distro Inc. within 7 days of receiving the order. Customers are responsible for inspecting their orders upon delivery.

6.3 Replacement and Credit Policy

Replacements or credits will not be issued after 7 days of receiving the Products. Claims for damaged or missing items must be accompanied by photographic evidence and a detailed description of the issue.

6.4 Cancellations

Orders may be canceled prior to shipment by contacting your sales representative. Once an order has been shipped, cancellation is no longer possible.

7. Warranties 

7.1 Product Warranty

Big Distro Inc. warrants that the Products will be free from material defects upon receiving the product. If the product is found to be defective upon delivery, the Customer must report the issue in accordance with the reporting policy outlined in Section 6.2.

7.2 Exclusions

The warranty does not cover damage caused by improper use, modification, or any form of misuse. Big Distro is not liable for any incidental or consequential damages.

8. Legal Use of Products 

All products distributed by Big Distro Inc. are intended exclusively for legal purposes. Customers bear the responsibility of ensuring that their acquisition and utilization of our products are in full compliance with all applicable local, state, and federal regulations. Big Distro Inc. disclaims any liability for the misuse of its products.

Customers are responsible for paying and handling any tobacco or vape-related taxes applicable in their state. Big Distro Inc. will not be held liable for any tax obligations arising from the purchase of our products. Customers are also required to provide Big Distro Inc. with a valid tobacco and / or vape permit as required by their state regulations.

10. Limitation of Liability 

To the fullest extent permitted by law, Big Distro Inc. will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Products, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount paid by the Customer for the Products.

11. Intellectual Property 

All content, logos, designs, and trademarks associated with Big Distro Inc. are the property of Big Distro or its licensors. You are prohibited from using our intellectual property without prior written consent.

12. Governing Law 

These Terms shall be governed by and construed in accordance with the laws of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of North Carolina.

13. Force Majeure 

Big Distro Inc. shall not be held liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, government restrictions, or natural disasters.

14. Amendments 

Big Distro Inc. reserves the right to modify these Terms at any time. Any changes will be posted on our website and will apply to all future transactions. Your continued use of our services after the effective date of the changes constitutes acceptance of the new Terms.
